PREAMBLE 


In accordance with the Luxembourg laws and regulation, Loterie Nationale, having its headquarters at 18 rue Léon Laval L-3372 Leudelange (hereafter “LN”) is authorized to offer to its clients betting services online (i.e. sport betting and virtual slots).
  • Purpose
To the extent that a player complies with the requirements set out below (hereafter collectively the “Players” and individually a “Player”), LN shall grant him/her:

- Access to the online betting platform Loteriesport (hereafter the “Platform”) which is accessible at www.loteriesport.lu; and
- An online account that can be used both on the Platform and on the gaming and betting terminals installed in LN’s authorized points of sales.
  • Scope of the GTC
The present General Terms and Conditions (hereafter the “GTC”) shall govern and apply to:
  • The use of the Platform by the Player,
The opening of a Player’s online account on the Platform that can also be used on LN’s terminals available on LN’s authorized points of sales; and
The placing of bets on sport events or via virtual slots on the Platform.
 
The GTC shall not govern the access to or use of any bets or games that are accessible via LN’s Terminals located at its authorized points of sale, except insofar as such access or use involves the Player’s online Account. All such bets and games shall remain subject to the specific rules, terms, and conditions applicable thereto, as made available directly on the relevant Terminal or published on LN’s official website.

The present preamble together with the below notice shall form an entire and integral part of the GTC and, consequently, of the agreement between LN and the Player.
  • Acceptance of the GTC
By accepting the GTC, the Player expressly acknowledges and agrees that he/she has read, understood and accepted the terms of the GTC. He/she agrees and acknowledges that:

- The acceptance of the GTC constitutes a valid and binding agreement between the Player and LN, effective as of the Player’s acceptance of the GTC;
- This agreement shall remain in full force and effect until the closure of his/ her Account (as defined below) for any reason;
- He/ she is legally bound by the provisions of the GTC as amended, supplemented or replaced from time to time, and
- He/ she shall comply, at all times, with the provisions set forth herein when accessing or using the Platform and/ or his/her online account.
 
IMPORTANT NOTE: The Player acknowledges that, in case of any breach of the provisions of the GTC, LN can take any measure it may deem appropriate and proportionate, with immediate effect, without any further act or formality,  including but not limited to the cancellation of bets, the suspension of the Account and/ or the closure of the Account (in accordance with the provisions of the GTC).

1. Definitions

Account” means the personal online player account opened by and in the name of the Player to access the Games available on the Platform and/ or identify and play/bet on the Terminals.

Available credits” means the amount in Euro and credits held on the Player’s Wallet and available to be used on the Platform. Available credits are made of:
  • Withdrawable Available credits:  the amounts credited by the Player as well as any winnings or gains of the Player; and
  • Unwithdrawable Available credits: the credits from bonuses or commercial offers that remain available for a limited period and cannot be either converted into cash amounts or paid out.

Betting rules” means the terms, conditions and rules applicable to the Games and betting events or options accessible and available on the Platform, as amended from time to time. The Betting rules are defined in Annex 1 and in the General betting rules available on the Platform. They are an entire and integral part of the GTC.

Chargeback” any charge returned to the payment method used by the Player, following a dispute request submitted by the Player for an item on their statement or transactions report. A chargeback can occur on debit or credit cards and can be requested for various reasons.

Credentials” means, as the case may be, the username, email address,  password, and/ or answers to the security questions defined by the Player to access and use the Platform.

Failure” means any disruption, error, malfunction or interruption of the Platform or any item of it.

Game” means any game, bet or event available on the Platform at any time.

GDPR” means Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC

GTC” means the present General Terms and Conditions as amended, supplemented or replaced from time to time. The GTC also includes any schedules and appendices attached hereto.

IPR” means any and all intellectual property rights, titles, and interest, including, where applicable, author’s rights, rights in designs, copyrights, trademarks and rights to sue for passing off and in unfair competition or forgery (whether or not any of these is registered and including applications for registration of any such thing) and all rights or forms of protection of a similar nature or having equivalent or similar effect to any of these which may subsist anywhere in the world.

LN” means Loterie Nationale.

Personal Data” means the Player’s data and other information constituting personal data under GDPR and processed as part of the Player’s registration to and use of the Platform.

Platform” means loteriesport.lu

Player” means the natural person who has accepted and agreed with the GTC,  enters into a contract with LN and holds an Account.

Prohibited practices” means any practice constituting fraud, money laundering or manipulation of bets that is strictly prohibited by LN as defined, amongst others, in sections 3.4, 4.2.4 and 9.1.

Terminals” means LN’s gaming and/ or sport betting terminals which are installed and made available in LN’s authorized points of sales.

Terminals Conditions” means the terms, conditions and rules applicable to the Games, and betting events that are available and accessible through the Terminals.

Wallet” means the virtual wallet used for holding the Available credits and available on the Account.
Unless the context requires otherwise, references importing the singular shall include the plural and vice versa.

2. Player’s representations and warranties

In order to register on the Platform and create his/her Account, the Player represents and warrants that: 
  • He/she is at least 18 years old with full legal capacity and judgment abilities and that he/she is not opening or facilitating the opening of an Account for a minor or an adult with incapacity;
  • The Account is strictly personal, He/ she will be the sole user thereof and that he/she shall not permit any third party, including but not limited to minors, to access or use the Platform, or to identify themselves and place bets or participate in games via the Terminals, using the Player’s Account;
  • He/ she is the holder of a bank account opened with a bank established and regulated in Luxembourg;
  • He/ she is an individual / physical person and not acting on behalf of a company or through an artificial intelligence allowing the automatic participation to bets or automatic choices for placing the bets;
  • He/ she will use the Platform, the Account and/ or the Terminals (as the case may be) for himself/ herself and will place the bet in his/ her own name and for himself/ herself and that he/she is not placing the bets or using the Platform on behalf of any third party or as a nominee for a third party;
  • He/ she is not, in any jurisdiction, under an interdiction to access gambling and betting services or applying any self-restriction order or measure;
  • He/ she is not treated for betting or gambling addiction as of the date of acceptance of the GTC;
  • He/ she does not already have another Account on the Platform.
  • He/ she will comply, at all times, with the requirements of the GTC;
  • He/ she will provide any information or document that may be requested by LN from time to time and that any such information and document are accurate, complete, not misleading or forged;
  • He/ she is using a payment method belonging to him/her and that he/ she is authorized to use for crediting the Wallet;
  • The money used to credit the Wallet is not the result of any illegal, illicit or fraudulent act or activity;
  • He/ she understands the actual and potential risks arising out of the use of the Platform and/ or the Terminals including (with no limitation) losing money or developing a pathological or excessive behavior with respect to gaming;
  • He/ she will not use the Platform, the Account and/ or the Wallet for illegal, illicit or fraudulent goals including but not limited for the purposes of money laundering or financing terrorism;
  • He/ she is not a participant to or involved in any Game as, amongst other, sportsperson, owner, trainer, coach, manager, or player (Please refer to point B of Annex 1 for additional details).

In the case LN discovers, detects or suspects, for any reason, that the Player does not comply with any of the above representations and warranties, it may suspend or close the Account with immediate effect.

The above representations and warranties granted by the Player will be considered as being repeated every time he/she accesses or uses the Platform or the Account (including when using the Terminals through the Account). They also constitute the pre-requisites for the opening of the Account.

3. Opening and management of the Account

3.1 Registration and opening of the Account
3.1.1 Registration and opening of the Account
In order to register on the Platform and create his/ her Account, the Player must:
  • Fill the registration form with accurate and complete information,
  • Provide LN with his/ her name, date of birth, mailing address, email address and phone number,
  • Create his/ her personal and unique username,
  • Choose a secure password,
  • Answer to the security question that will enable LN to identify the Player and to allow the Player to reset his/ her password or modify certain of his/ her Personal Data or Account information,
  • Provide LN with his/ her banking details in IBAN form.
The Player shall only open an Account for himself/ herself. He/ she shall not create an Account for or on behalf of another person or act as a nominee for such person.

All information and document provided by the Player must be accurate, complete not misleading or fraudulent. Only a bank account opened with a bank established and regulated in Luxembourg will be accepted by LN.

The username is strictly linked to the Account. The Player is invited to choose it with care as he/she will not be allowed to modify it after the activation of the Account. The username shall not be offensive, degrading, breaching any third party’s intellectual property rights, indecent, obscene or misleading. LN reserves the right to (i) refuse or reject any username that it may deem, at its own discretion, as being inappropriate or unacceptable and/ or (ii) suspend the Account.

The Player acknowledges and agrees that LN may use or refer to his/ her username and his/her rank, without requesting the Player’s prior consent, when displaying Leaderboards for online slot games (without displaying any other Player’s Personal Data).

Once the registration process described above is completed, the Account is created and activated. At that time, the Player will be able to credit his/ her Account as described in section 3.2 and to set his/ her betting limits in accordance with the procedures set in section 8.2 below. He/ she will also be allowed to place bets. He/ she will also be allowed to use .and wager the Available Credits, whether on the Platform or via the Terminals, provided that identification is completed through the Player’s Account.

Notwithstanding the foregoing, before the Account is verified and confirmed, the Account will be under the status “non-confirmed” and some functionalities may be restricted. In addition, the Player will not be allowed to transfer any Available credits or gain/ winnings to his/her bank account before its Account is verified and confirmed by LN.

The creation of an Account does not create any commitment or undertaking on LN’s side to permanently accept the Player on the Platform. LN reserves the right to refuse the confirmation (as described below) of any Account for any reasonable grounds.
 

3.1.2 Confirmation and verification of the Account

Within the 90 (ninety) days following the opening of his/ her Account, the Player shall request the confirmation of it by sending to LN via the Platform the following documents:
  • A copy of a valid identification document (e.g. valid passport or ID card), and
  • A copy of a banking statement (RIB) issued by a bank established and regulated in Luxembourg.
LN shall perform all identification and other verification checks that it may deem as being reasonably necessary or required by applicable laws. Such verification and checks will be generally made on the basis of the information and documents received from the Player as well as on any additional information or document reasonably requested by LN.

LN is authorized to permanently and immediately close any Account in the following cases (the below list may not be exhaustive):
  • The Player is less than 18 years old;
  • The verifications performed by LN are not fully satisfactory;
  • The Player does not match the pre-requisite conditions as set out in clause 2.1,
  • The documents and/ or information provided by the Player appear to be inaccurate, incomplete or forged.
In such circumstances, all transactions made in the Account will be considered as void and all Available credits will be returned to the Player using the same payment method used for crediting the Account (to the extent reasonably practicable).

3.1.3 Betting limitations

When opening the Account, the Player shall set his/ her credits and Games limits in accordance with section 8.2 below. These limits shall apply indistinctly to the use of the Platform and/ or the Terminals, without exception or specific restrictions.

3.1.4 Absence of confirmation

In the event, the documents required for the confirmation of the Account (as listed in clause 2.2.2) are not received within the 90 (ninety) days of the opening of the Account, the Account will be suspended until further information is received from the Player.
In that case, the Player shall be prevented from accessing and using the Games on both the Platform and the Terminals. All transactions made in the Account will be considered as void and all withdrawable Available credits will be returned to the Player by bank transfer provided that the Player has provided LN with its bank account number beforehand.

3.2b Crediting the Wallet

Neither placing bets nor using the Terminals through the Account will be allowed before the Player credits the Account, in compliance with the below provisions unless the Player has received free bets credits through bonuses or special commercial offers. Available credits will be reflected on the Wallet.

3.2.2b Currency

Only amounts in EURO can be credited on the Wallet.

3.2.3b Minimum and maximum credits

The minimum amount to credit the Wallet is 5€ (five euros). The maximum amount to credit the Wallet is 2500€ per month and 500€ per transaction. LN reserves the right to increase or decrease such minimum and maximum amounts, at any time.
The maximum amount for crediting the Wallet will be determined by the Player, based on the limitations set by himself/ herself.

3.2.4 Accepted payment method

Payments to the Wallet shall be made by means of:
  • Credit card issued in the name of the Player by a bank established and regulated in Luxembourg or in any European Union Member State, or
  • PayPal (using the Player’s own account).
Payment methods belonging to companies are not accepted.

Any rejection of payment will automatically be notified to LN. When payment requests are rejected five times, LN may temporarily suspend the Account until further information is received from the Player.

3.2.5 Ownership of the Available credits

The withdrawable Available credits (as defined in the definition of “Available credits” in section 1) are and remain the Player’s sole property. Subject to LN’s rights and duties as set out In the GTC including but not limited to section 6.3 and 13.3.4, the Player can request the payment on his/ her bank account of the withdrawable Available credits at any time.
Subject to LN’s rights and duties as set out in the GTC including but not limited to sections 6.3 and 13.3.4, nothing in the GTC is constructed to transfer, assign or created in LN’s favor, any right of retention, pledge or any other rights or privilege with similar effects on the withdrawable Available credits.

3.3 Changes to the Account

The Player shall be able to modify certain data and information related to him/ her and/ or to the Account (phone number, email address, password, security questions and mailing address). However, some of the information and data registered in the Account cannot be modified by the Player alone. Such modification shall only be made with LN’s assistance  (e.g., bank account number, civil state…). To verify properly and safely the Player’s identity, LN will request the Player to answer one security question before accepting changes to the Account.
In that case, LN will request the Player to provide supporting evidence of the requested change (e.g., for instance new banking identity or copy of ID card). If the Player fails to provide such evidence within 30 (thirty) days, LN shall suspend the Account until further information is received from the Player.

3.4 Prohibited practices

3.4.2 Opening of duplicate Accounts

Each Player can only open one single Account. Opening or operating several Accounts for the same Player is strictly prohibited.

The Player acknowledges that LN has implemented measures to prevent and avoid the opening of duplicate Accounts by the same Player. Such measures may include, amongst other, (i) checking the Player’s IP address, terminal used for accessing the Platform, payment methods (e.g., bank card with the same number), bank account number, address, email address, phone number and/ or (ii) detecting identical bets at the same time or within the same time slot.
 
When LN discovers or suspects that the Player has opened more than one Account, each of the additional Accounts will be classified as a duplicate Account and LN may, at its discretion:
  • Close any or all of the Duplicate Accounts and keep the first Account opened by the Player,
  • Declare all bonuses and free bets and all related winnings as undue and void,
  • Void all bets made through one or several duplicate Accounts, and/ or
  • Retain all Available credits held on the duplicate Accounts in accordance with section 6.3.

3.4.3 Other forbidden practices

 The Platform, the Account (used whether on the Platform or the Terminals) and/ or the Wallet must not be used by a Player by mean or for the purpose of carrying out Prohibited practices.

3.5 Disclaimer

3.5.1 Payment service providers

Payment services linked to the Platform are operated by a third party established and regulated in the European Union. Such payment services provider shall not be considered as a LN’s subcontractor. LN disclaims any and all liabilities and responsibilities in case of delay of payment, dysfunction or interruption of the payment channels and/ or in case of unavailability of such payment channels.

3.5.2 Nature of the Available credits and of the Account

LN is not a credit institution/ a bank (as defined by Regulation (EU) No 575/2013), a payment institution (as defined by Directive (EU) 2015/2366 of 25 November 2015 or PSD2), or an electronic money institution (as defined by PSD2).

LN’s activities or the operation of the Platform shall not be considered or construed as:
  • Receiving cash deposits or other repayable funds from the players,
  • Granting credits to the players,
  • Providing payment services, or
  • Issuing electronic money.
The Wallet and the Account are not banking accounts. None of them can be used for depositing or holding cash or funds in deposit. The Available Credits held on the Wallet will not earn any interest. In case LN suspects an inappropriate usage of the Account or Wallet (e.g. deposits and withdrawals made by the Player without any placed bets), LN may suspend the Account, request detailed explanations from the Player and/ or, as the case may be, decide to close the Account.

The Available credits are exclusively meant to allow the Player to place bets through the Platform or the Terminals. They shall not be considered or construed as being deposits or advances of cash or money. The Available credits cannot be used to access other services or for the purchase of any goods.

4. Use of the Account and of the Platform

4.1  Identification on the Platform

The Player shall identify himself / herself by entering his/ her Credentials every time he/ she accesses to the Platform or the Account. As outlined before, the Player shall not act for or behalf of another person or acts as a nominee for such person.

The Player shall never disclose or share his/ her Credentials with any person or entity. The Player is fully responsible for protecting his/ her Credentials from unauthorized use or access. He/ she shall pay a particular attention to ensure that such Credentials are not used by his/her minor or vulnerable relatives.

The Player is responsible and liable for any transaction and operation made on the Platform or the Terminals by mean of his/ her Credentials. LN shall assume and rely on the fact that any person using the Credentials is the actual Player. LN has no responsibility or duty to verify that the identification information and/ or the Account are actually used by the Player and not by an unauthorized person. LN specifically disclaims any liabilities or responsibilities for any loss, damage, expense, cost or liability incurred by the Player resulting from the use (whether authorized or not) of the Credentials and/ or the Account by another person.

The Player shall immediately notify LN in case his/ her Credentials are lost or stolen. To properly and safely verify the Player’s identity, LN will request the Player to answer to one or more of the security questions. In that case, LN shall suspend the Account until further instruction or information is received from the Player.

4.2 Placement of bets

Note. The present section 4.2 only governs the placement of bets on the Platform. All bets placed via Terminals shall be governed by the applicable Terminals Conditions.

4.2.1 Available credits 

Placing bets will only be possible if the Player has sufficient Available credits on the Account. In the event, Available credits are not sufficient, the Player shall credit his/ her Wallet in accordance with the provisions of section 3.2.
Every time the Player places a bet, the amount of the bet is deducted from the Available credits.

4.2.2 Betting rules and information

The Player can bet on different sports through the Platform. Rules specifically applicable to bets are defined in the applicable Betting rules.
LN disclaims any representation and warranty and exclude any liability or responsibility in connection with the completeness, timeliness, fitness for a particular purpose or accuracy of the information provided by third parties including but not limited to, all information contained in live scores, statistics, results, scores, team comparisons, and tables.

4.2.3 Placing bets

Subject to section 4.2.5, Bets placed by the Player shall only be considered as valid when the betting offer transmitted by the Player is accepted and confirmed by the Platform. When placing a bet, the Player shall verify the accuracy and completeness of all elements of the bet before validating it. The Player is responsible for verifying and ensuring that all details of the bet are correct.

The Player acknowledges that some delay may happen between the moment where the Player places his/ her bet and its acceptance and confirmation by the Platform.

Once the bet is accepted and confirmed by the Platform, the Player will no longer be allowed to modify or cancel such bet. From such acceptance, all elements of the bet shall be considered as duly validated by the Player and no claim made by the Player in relation to such bet will be considered.

LN's records shall be considered as the sole and authentic evidence to be taken into account for the interpretation and the verification of the content of the bet placed by the Player.

If, after the acceptance of the Platform, it appears that the content of a bet – for whatever reason – is neither determined nor correct, the bet is invalid, and the stake will be refunded.

4.2.4 Prohibited practices

  • Personal involvement
 
The Player shall not place any bets, for himself/ herself or acting for or on behalf of another person, on events in which he/ she is involved. In case of LN discovers or suspects a violation of this provision, LN reserves the right to cancel any bets, refuse the payment of winnings and/ or refund of bets.

  • Usage of AI technologies and prohibited software

LN strictly prohibits the usage of:

- Artificial intelligence systems or technologies enabling the Player to automatically place bets or make automatic choices.
- Any system (e.g., machines, computers, software, or artificial intelligence) or other automated systems such as ‘bots’ to bet via the Platform or to circumvent or exploit LN bookmaking or gaming system, and/ or
- Software which allows opponent profiling, players’ collusion or any other program which allows or assists the Player to cheat or gives the Player an unfair advantage over another player.

In the event LN discovers or has reasonable suspicions that a Player is using such AI technologies or prohibited software, it may, at its own discretion, suspend the Account with immediate effect, retain the payment of any gains in accordance with section 6.3 (suspected to have been won thanks to AI technologies or a prohibited software) and/ or close the Account.

4.2.5 LN’s rights and duties

  • Request additional information and documents
LN is authorized to request, at any time, to the Player any additional and information that it may deem necessary, relevant or reasonable. Such additional and information will, among other things, enable LN to perform checks and verification in relation to the Player and the Account. The Player shall provide such additional information and documents upon receipt of LN’s request.

In case LN does not receive the request information or document within a reasonable time, it may suspend the Account without further notice.
  • Cancellation, correction and limitation of bets
LN has the right to cancel or correct bets, calculations, odds or other errors at any time including after the acceptance and confirmation of the relevant bets. In such circumstances, a correction or cancellation information will be sent to the Player through the Account.  

LN may, at its own discretion, cancel betting placed and confirmed in case such bets or odds do not comply with the Betting rules and/ or as a result of an obvious or serious errors that will render the bets impossible, implausible, unpracticable or unlikely to be executed.

LN may also set specific limits for certain bet. A maximum global betting amount may be set by LN according to the relevant odd, sport, nature of the bet and/ or the importance of the competition. This kind of limitation will lead to capping the maximum amount that may be gained by players.

LN reserves the right to refuse to accept betting offers from the Player in some cases. This can be done at any time, to limit the number of bets before accepting bets and/or to make changes to the odds before the Player’s bet is concluded. LN also reserves the right to set payout/win limits and binding odds for the Player, or to exclude players from participation in the LN's offer, without giving any reasons.

4.2.6 Early withdrawal

LN may allow the Player, for certain bets, to make a cash out offer. LN has no obligation or commitment to accept such offer. The offer to cash out is considered as fully accepted only when LN has issued a confirmation to the Player. The price or odds for an early withdrawal depends on the status of the bet at the time of the request. LN reserves the right to propose changes at the odds at any time.

LN refuses any liability or responsibility for any loss or damage incurred by the Player arising out or related to the improper or incorrect calculation or payment of a settlement amount. This approach also applies to bets that are fully settled with the withdrawal option.

In case of an obvious error is detected on prematurely settled bets (before the start of an event, during or after an event) with incorrect withdrawal amounts (due to incorrect odds on which the amount was based), they shall remain valid and shall be revaluated with the correct amount. If a bet has been settled after an incorrect outcome with the withdrawal option, the bet will be re-evaluated to the correct outcome.

4.3  Payment of gains

Gains will be calculated in accordance with the applicable Betting rules. The maximum amount that can be won with any ticket is 50 000€ (fifty thousand euros) for singles and combination bet and 100.000€ (One hundred thousand euros) for system bets, unless otherwise agreed by LN (i.e. in case of promotions or bonus).

Gains won by the Player will be added to the Available credits after the evaluation of the bet. Only a Player with a confirmed Account (as explained in section 3.1.2) will be allowed to convert the Available credits in cash and request the transfer of such amount to the Player’s bank account. If the Account is not confirmed, gains will only be added to the Available credits without any possibility of transfer.

4.1  Simultaneous use of the Account on the platform and terminals

In addition to playing or placing bets on the Platform, the Player may access his/her Account to engage in gaming or betting via the Terminals. In such cases, all games and bets shall be governed by the applicable Terminals Conditions.
Identification via the Account on the Terminals is not mandatory. However, when playing or betting in an identified mode, the Player shall have the ability to:
  • Play or place bets separately or concurrently on both the Terminals and the Platform;
  • Utilize the Available Credits of the Wallet for gaming or betting on the Terminals;
  • Resume ongoing Games in the event of an interruption or technical malfunction of the Terminals;
  • Prevent the loss of wagered amounts on a bet or game prior to the bet placement or the Game’s completion in the event of an interruption or technical malfunction of the Terminals.

4.4 Other available Games

Games other than bets, including virtual slot machines, may be accessible via the Platform, with any winnings from such Games being credited to the Wallet. These games are subject to their own dedicated rules, as set forth on the Platform.

Slot games are also available on the Terminals and may be played using the Available Credits of the Account. Such games are governed by the applicable Terminals Conditions.

5. Bonuses and promotional offers

Note. The present section 5 only governs the bonuses and promotional offers granted to the Player on the Platform.

5.1  Recipients of bonuses and promotional offers

LN may offer bonuses and promotional offers, on a selective basis, to specific categories of players who meet specific criteria. LN is authorized to limit the number of Player eligible to such bonuses and special offers.
All bonuses and promotional offers sent directly to the Player are specific, personal, non-transferable and non-assignable. The Player shall not transfer, assign, resell, distribute or communicate such bonuses and offers to another player or try or facilitate any of such actions. When a bonus or promotional offer is received by a player of the Platform who is not the intended recipient of it, the bonus or promotional offer will not apply to him/ her.

5.1  Applicable terms

Bonuses and promotional offers (i.e. free bets) may apply to specific bets only.  Bonuses or free bets are credited on the Wallet and remain available for the duration of the validity period. Additional credits resulting from bonuses and promotional offers are unwithdrawable Available credits (as defined in section 1). As such, they cannot be redeemed for real money, cannot be converted into cash amount and be transferred to the Player’s bank account.

All bonuses and promotional offers are subject to dedicated terms and conditions provided upon notification of the bonus offer and promotional offer to the Player. When accepting to benefit from a bonus or promotional offer, the Player agrees to comply with the terms and conditions specifically applicable.

Bonuses and special offers remain usually valid for a determined period of time.  When LN does not specify a period of validity, the offer ends when it ceases to be available and has been interrupted by LN. Bonuses and promotional can only be claimed once during the specified period. Once the validity period expires, the Player will not be able to claim or reclaim for benefiting of the lapsed bonuses and offers.

Notwithstanding the foregoing, LN may terminate, suspend or change bonuses and promotional offers at any time and for any reason.

5.2  Refund or cancellation of bonuses and promotional offers

LN reserves the right to claim for the refund of all bonuses and promotional offers, cancel winnings made thanks to such bonuses and offers and/ or refuse to pay gains in the following cases:
  • LN discovers or suspects that the Player has obtained such offer or bonus as result of a fraud, criminal offense, deception, bribery, forgery, extortion, corruption, theft, conspiracy, embezzlement or misappropriation;
  • The Player is part of a group of players who have agreed to participate in the offer without any authorization or by acting as a syndicate; or
  • LN discovers or suspects that the Player signs up multiple time, creates false Accounts or uses nominees to benefit from bonuses and promotional offers at multiple times.

6. Transfer of the Available credits

 The present section only applies to the withdrawable Available credits. It does not cover in any manner unwithdrawable Available credits that do not entitle the Player’s to any cash payout.

6.1  Pre-requisites

Transfer to whole or part of the Available credits will only be allowed if the below cumulative conditions are met:
  • The Account is confirmed in accordance with section 3.1.2;
  • The minimum amount for a transfer is 10€ (ten euros);
  • The Player has provided to LN the details of his/ her bank account in IBAN format. Such bank account must be opened in the name of the Player with a bank established and regulated in Luxembourg;
  • LN has verified satisfactorily and accepted the information provided by the Player;
  • All payments made to the Player’s Wallet are cleared and have not been charged back, reversed or otherwise cancelled; and
  • The Account is not under any investigation from LN for, amongst other reasons, fraud, error, illegal or illicit practices or malfunction.
For the avoidance of doubt, any amount wagered or bet using a remittance ticket (i.e., a ticket issued upon the deposit of cash into the Terminals) shall not be credited to the Wallet or added to the Available Credits. Any winnings or remaining balance following gameplay or betting on the Terminals shall be settled exclusively through the issuance of a new remittance ticket, which may either be exchanged at the Terminals or used for subsequent gameplay or betting at a later stage.

6.1 Transfer of the Available credits

Payment of the Available credits will only be possible by transfer to the Player’s bank account. For the sake of clarity, transfer of the Available credits will only be possible to a bank account opened and held in the Player’s name. Transfer to accounts opened and held by another person is strictly prohibited.

Subject to section 6.3, Available credits shall, to the extent reasonably feasible, remain available, at all times, for being transferred to the Player’s bank account, provided that the conditions set forth in section 6.1 are fulfilled. All fees related to the transfer of the Available credits shall be entirely borne by the Player, without no compensation or possible refund from LN.

In the unlikely event the transfer of the Available credits to the Player’s bank account cannot be made because of technical or operational difficulties, LN shall request the Player to provide an alternative method of payment and, as the case may be, additional documentation.
LN reserves the right to request any additional information or document before processing the payment of the Available credits.

6.1 Retention of the Available credits and delayed payment

Notwithstanding anything to the contrary in the GTC, LN reserves the right to retain, at any time including (but not limited to) during suspension or closure of the Account, the Available credits and to withhold their transfer to the Player’s designated bank account in the following circumstances:
  • The Player is suspect of or  involved directly or indirectly or has attempted to engage in any illegal or illicit activities;
  • The retention of the Available credits is mandated by an order of a competent judicial or administrative authority; or
  • The Player is involved directly or indirectly in or has attempted to engage in one or several Prohibited practices or practices constituting a breach of the GTC (e.g. fraud, duplicate accounts, AI manipulation…).
In addition, LN reserves the right to delay any payout or to request the provision of additional document or information before making any payment, for any reasonable grounds.

Amounts held or retained by LN do not earn any interest. In addition, LN reserves the right to charge to the Player fees for the holding of the Available credits.

7. Availability and changes

7.1 Availability of the Platform

7.1.1 Occurrence of a Failure

LN shall make its reasonable efforts to ensure that the Platform will run properly and be available in an appropriate manner throughout out the duration of the relationship between the Player and LN. Although LN is making reasonable efforts to provide a high-quality Platform, LN cannot guarantee that the Platform will be available and accessible at all times.

In the event of Failure, LN will make reasonable efforts to remedy such Failure and provide adequate workaround or corrective measures as soon as reasonably practicable. In the presence of a Failure (including when such Failure is not detected yet by LN), the Player undertakes that he/she shall act in good faith and refrain from taking any advantages of  such Failure for himself/ herself and/ or other players.
 
In relation the Games:
  • Where a Failure occurs after LN received notification of the Player’s bet and, where the Player can have no further influence on the outcome of the event or bet, the results of the bet will remain;
  • Where a Failure impacting a single-participant single stage event occurs before an outcome has been confirmed by LN, LN shall recredit the Player’s Wallet with the amount of the cancelled bet;
  • For Games where there are multiple stages or decision points, LN shall take reasonable steps to restore the Game, in the last known state it was before the occurrence of the Failure, to enable the Player to complete the game; and
  • For Games with progressive jackpots, progressive jackpot values will be restored to the extent reasonably feasible for LN, to the state they were before the occurrence of the Failure.
If as a result of a Failure, undue gains or winnings are mistakenly credited on the Player’s Wallet, LN shall, without any further act or formality, cancel the relevant transaction and withdraw the undue amount from the Wallet. In the event the Player have already used the undue credits, he/ she shall reimburse LN without delay.

No warranty or representation is given by LN about the availability, quality, operation or support of internet and/ or any other automated systems that provide the Player with access to the Platform.

7.1.2 Notification of a Failure

LN shall notify the Players in case of unavailability of the Platform by displaying warning notice on the Platform, within a reasonable period of time after discovery of the Failure.
The Player shall promptly notify LN in case he/ she discovers or suspects that a Failure is affecting or is likely to affect the Platform and/ or any of the available Games or betting option available on the Platform.

7.1.3 Maintenance of the Platform

LN is authorized to develop, modify, or suspend the availability and operation of the Platform, from time to time, due to operational, technical, legal or urgent maintenance constraints. To the extent reasonably practicable, if it is foreseeable that the Platform will be unavailable or available to a limited degree for a particular period of time, LN shall inform the Players of this unavailability within a reasonable period of time in advance.

7.2 Changes to the Betting rules and services

The Player acknowledges and agrees that LN may amend the Betting rules, suspend certain Games or betting option or remove certain Games or betting options between the payment of the Available credits and the date such credits are actually consumed by the Player.
LN shall ensure that any of the above changes will solely occur after a reasonable period so as to leave to the Player the opportunity to use part or whole of the Available credits before such changes become effective. Notwithstanding the foregoing, it is agreed that any changes required for mandatory or legal reasons will be implemented without prior notice.

8. Responsible gaming

8.1 Warning

The Player acknowledges that the regular practice of gambling and/ or betting may expose him/ her to risks like, amongst others, debts, isolation, family conflicts and gambling/ betting addiction.

In order to limit the Player’s exposure to the aforementioned risks, LN has set up prevention and mitigation measures:
  • The Player is requested to set limits, as described in section 8.2;
  • The Player can exclude himself/ herself from the Platform temporarily or for good;
  • LN performs regular controls to identify unusual or excessive behaviors (as set out in section 8.4), and
  • LN has implemented safer gambling and betting tools, as explained at:

9.1  Limits

The Player is requested to set an adapted framework for his/ her practices of Games and betting by setting a monthly maximum amount to be credited on the Wallet,
All limits and thresholds are part of the settings of the Account.
The Player can modify the monthly limits and thresholds at any time via the Account or by contacting LN The decrease of such limits will become immediately applicable whereas the increase of such limits will become effective 24 (twenty-four) hours after the receipt of the Player’s request by LN.
 

8.2 Self-exclusion

The Player may request a self-exclusion from the Platform and the blocking of the Account for a limited or unlimited period. During the Exclusion period (as defined below):
  • The Player will not be allowed to access or use the Account to play or bet on the Platform and/ or to identify on the Terminals;
  • Available credits will be kept on the Account.
  • The Player shall send a written request to LN when he/she wants the withdrawable Available credits to be transfered on his/ her bank account. 
The self-exclusion period shall be between 1 (one) day to 186 (one hundred and eighty-six) days, as determined by the Player (hereinafter the “Exclusion period”). Upon expiry, the Exclusion Period can be extended for a single or subsequent Exclusion Periods as defined by the Player. Any outstanding wagers or bets at the time of the Player’s self-exclusion will be settled in the normal way, according to the normal timescales and potential winnings shall be paid to the Player.

During the Exclusion period, LN shall refrain from sending marketing or commercial material to the Player, and from accepting any credit on the Account.

Any Account blocked due to self-exclusion cannot be unblocked during the Exclusion period. After the expiry of the Exclusion period, the Account will automatically be reactivated, unless (i) the Player has requested the extension or renewal of the Exclusion Period, (ii) LN’s has been instructed otherwise or (iii) for reasonable grounds.

During the Exclusion period, the Player shall not circumvent or attempt to circumvent the self-exclusion by creating, for instance, a new Account under a different username or by using the Account of a different player. LN shall not be liable for any losses, damages, expenses or costs that may be suffered by the Player or a third party resulting from the fact that the Player circumvents the procedures or systems in place to starts or continue betting despite of the self-exclusion.

Such self-exclusion may be requested either directly via the Account settings or by sending an email to support@loterie.lu.

8.3 Controls performed by LN

LN will perform regular controls on the practices and behavior of the Player to identify potential suspicious or excessive practices or behavior. Where such controls show an important financial risk for the Player or excessive or pathologic behaviors, LN may apply limits to the Player and/ or suspend or close the Account temporarily or permanently.

9. Fight against fraud, money laundering and fraudulent manipulation

9.1 Prohibited practices

In compliance with the applicable laws and regulations, LN has implemented control procedures and measures to prevent and fight against fraud, money laundering, terrorism financing and fraudulent manipulation.
The Player acknowledges and agrees that the below practices are strictly prohibited (the below list may not be exhaustive). He/ she also undertakes, during the whole duration of the agreement in place between the Player and LN, to not:  
  • Transmit inaccurate, misleading, incomplete or forged document or information,
  • Acting for or on behalf of another person or act as a nominee for such other person,
  • Use a nominee or a false identify to open or operate the Account,
  • Open or hold at the same time duplicate Accounts (as described in section 3.4.1),
  • Close an Account and open a new Account shortly after, in a recurring, abusive or unexplained manner,
  • Use the Account as a bank account to deposit money or funds,
  • Credit the Wallet with stolen, cloned, illegal or fraudulent payment methods or with money coming from criminal or illegal activities,
  • Take advantage, in a systematic and recurring manner, of Failures and/ or maintenance of the Platform,
  • Place, in a recurring manner, multiple bets having dependent results,
  • Bypass or circumvent security or safer checks of the Account or of the Platform (or attempt to do so),
  • Manipulate or attempt to manipulate the results of the betting services and/ or the operation of the Platform by concerted practices including but not limited by making alterations to the Platform or in any other way,
  • Get involved in any form of collusion (i.e., coordinated or unsolicited team play) or cheating,
  • Use any system (e.g., machines, computers, software, or artificial intelligence) or other automated systems such as ‘bots’ to bet via the Platform or to circumvent or exploit LN’s bookmaking or gaming system,
  • Use software which allows opponent profiling, players’ collusion or any other program which allows or assists the Player to cheat or gives the Player an unfair advantage over another player,
  • Use the Account in any manner that LN deems, for reasonable grounds, to be fraudulent, dishonest or criminal,
  • Collect Personal Data of other players without their explicit prior approval,
  • Share the Account with other players,
  • Upload or try to upload any kind of virus or spam or software attempting to cause any other kind of interference, disruption or interruption of the Platform,
  • Receive a Chargeback as defined in section 1,
  • Continue betting through the Platform while the Player becomes bankrupt, or
  • Breach the applicable laws, regulation, the Betting rules, the provisions of the GTC and/ or the terms and conditions of bonuses or promotional offers.

10.1 LN’s rights and duties

In the event LN discovers or suspects the Player to carry out Prohibited practices, it shall opt for one or several of the below measures, whichever seems to be more appropriate or proportionate to LN:
  • Suspend the Account temporarily until LN’s investigation is satisfactorily completed, or
  • Close the Account with immediate effect,
  • Send a report that may include data stored in the Platform and in the Account to the competent authorities (e.g. Cellule de renseignement financier),
  • Require the Player to reimburse or withdraw from the Account any amount, payouts, bonuses, and/or any winnings that are attributable to those Prohibited Practices.
  • Transmit the relevant data stored in the Platform to sports associations or involved other third parties for the purpose of clarifying a possible suspicion or manipulation of the bet. This also includes information about suspicious bets;
  • Retain the Available credits in accordance with section 6.3.
The Player commits to provide LN, without undue delay, with further information/documentation as request by LN during its investigation.

If LN’s investigation concludes that no Prohibited practices has been made by the Player, the Account suspension will be lifted within a reasonable period of time. If the investigation carried out by LN shows that the Player has been involved in Prohibited practices or in the event the Player has failed to provide LN with the requested information within the agreed timeframe, LN shall permanently close the Account with immediate effect and without further notice. In such circumstances, LN reserves the right to refuse the Player to open a New Account within a period up to 5 (five) years.

In case LN closes the Account under the circumstances described above, the Available credits will be transferred to the Player’s bank account. However, LN may retain whole or part of the Available credits in accordance with section 6.3.

10. Intellectual property

11.1  IPR related to the Platform

All IPR related to the Platform including but not limited to the underlying system and structure, the content of it are and remain the sole and exclusive property of LN or its possible licensors. The Player shall not contest the ownership of such IPR.

Nothing in these GTC is constructed or intended to assign, transfer, license or create in the Player’s favor any entitlement or right in connection with the aforementioned IPR other than the rights granted under these GTC.

12.1 Trademarks

LN’s logo, name and other trademarks are and remain LN’s sole and exclusive property. Nothing in the GTC is intended to assign, transfer, license or create in the Player’s favor any entitlement, license or right in connection with LN’s logo, name and other trademarks.

10.1 Infringement

If a third-party claim or litigation is made or brought against the Player alleging that the use of the Platform infringes upon any IPR, LN shall indemnify and hold harmless the Player against those damages, liabilities, and costs (including reasonable attorneys’ fees) that are incurred by the Player as the result of such third-party claim or litigation. LN shall defend or settle such claim or litigation at its own costs. The Player will provide reasonable cooperation to LN.

In the event of a claim of infringement, LN shall use all reasonable efforts to (i) modify the Platform (as applicable) so that it is non-infringing or (ii) replace the disputed portion of the Platform by non-infringing items that have equivalent performance and functionality.  

11. Personal data protection

11.1 Data controller

LN is acting as data controller (as defined in GDPR) for all Personal Data related to the Player.

11.2 List of the processed Personal Data

LN processes and collects the following Personal Data:
  • The Personal Data provided by the Player for the creation, administration and management of the Account:
o   Identification data: name, first name, username;
o   Contact details: phone number, address, email address…
o   Banking and payment details (e.g. IBAN of his/ her account, name of the bank, credit card number…)
o   Identification information: age, date of birth, copy of ID card, gender, information coming from external sources related to the Player…
o   Credentials,
o   Correspondence with the helpdesk/ customer service,
o   Replies to security questions,
o   Complaints,
  • Connection data: device information, source and destination data, IP address, cookies transmitted information…
  • Personal Data collected when playing Games: gaming and betting limits, gaming and betting history, date and hours of connection…
  • Any other possible information or data that the Player may disclose to LN when contacting LN’s customer/ support service.

11.3 Legal grounds for the processing of the Personal Data

Personal Data are processed by LN:
  • For the proper execution of contractual obligations as set out in the GTC and the agreement in force between the Player and LN,
  • For the purpose of complying with applicable laws and regulation especially (without limitation) the Law of 12 November 2004 on the fight against money laundering and terrorist financing, as amended from time to time and rules applicable to responsible gaming, and
  • On the basis of the Player’s consent: consent is required for customized offers. When accepting the GTC, the Player also agrees with the processing of his/ her Personal Data including credit card information that is necessary for the completion of the payments made by the Player.

11.4 Purpose of the processing of the Personal Data

11.4.1 Creation, management and administration of the Account and of the relationship with the Player

LN uses the Personal Data to create, manage, administer the Account and to support the commercial relationship with the Player.

LN is legally obliged to check that the information provided by the Player is accurate, complete and up-to-date. LN may therefore contact the Player at any time to check that the data and information provided by him/ her is correct and/or to provide additional documentation or evidence.

In order to provide the Player with the best possible service, LN also process the Personal Data to manage the Player’s requests and complaints to the Customer Service department. In this context, LN may also record the telephone calls and correspondence with the Player. LN also carry out analyses of requests made by the Player via various contact channels (e.g. telephone, e-mail, social networks, etc.) in order to improve LN’s operational processing of these requests and to give LN a more global view of the reasons for customer satisfaction, dissatisfaction, contacts and complaints.

11.4.2 Prevention of excessive gaming and controls on responsible gaming

LN has implemented and maintains controls and checks to detect actual or potential excessive gaming and betting through, amongst other, the monitoring of the time spent on gaming/ betting and the amounts credited on the Account.  The Player may also set daily or weekly limits for his/ her gaming/ beeting activities and Credits.

11.4.3 Management of payments

The banking and credit card information that are shared by the Player is processed for the purposes of (i) managing the transactions relating to the Account and Wallet, (ii) crediting the Wallet and (iii) making payment to the Player.

Bank account details (IBAN) are used for the sole purpose of converting the Available credits in cash amounts and transferring them to the Player’s bank account.

The Player’s payment card details are securely stored to record financial transactions (as required by the applicable laws) and to facilitate later payments. Facilitation of payments allow the Player to not have to re-enter his/ her credit card number each time he/ she makes a payment to the Wallet. Each payment card transaction is processed by â PCI-DSS-certified online payment service provider (international security standard ensuring the confidentiality, security and integrity of credit card and transaction data). The Player will be able, at any time, to to request to LN customer / support service his/ her credit card information stops appearing on the Account for future purchases.

11.4.4 Personalization of services and online advertising

In accordance with the Player’s choices, the Personal Data collected may also enable LN to (i) determine the Player’s trends, (ii) offer him/ her a personalized user experience, offers tailored to his/ her interests or (iii) allow the Player to benefit from promotions and/or e-credits based on his/ her gaming and betting habits.

11.4.5 Studies and statistics

LN may process the Personal Data for statistical or research purposes in order to develop its products and services and personalize its relationship with the Player.

11.4.6  Combating fraud, money laundering and the financing of terrorism

In accordance with LN’s legal obligations to fight against fraud, money laundering and terrorism financing, LN shall carry out checks on the Personal Data upon creation of the Account, during the Account’s lifetime and/or in case of payment of winnings. This process also enables LN to apply a high level of security for the Player’s Personal Data, especially regarding prevention of fraud, identity theft and payment security. For that purpose, LN asks the Player to provide a copy of his/her ID card and bank details, so that LN can check that the information registered in the Account matches the data on these documents. This check enables LN to eliminate any possible inconsistencies between the data transmitted by the Player and/or to limit any risks associated with the documents provided by the Player (e.g. identity documents or supporting documents presenting a risk of falsification). According to the type of error and/or the level of risk identified by LN, LN may take different measures (e.g. rectification of the Personal data in case of a simple input error, or, where a risk of fraud is likely or threatens to happen, blocking or closure of  the Account in accordance with the GTCs).

In addition, in order to ensure to the Player an optimal experience and to prevent fraud to the Games, LN has implemented and maintains controls and checks requiring the process of Personal Data. These controls enable LN to detect, amongst others,  potential cheating, breach to the Gaming rules, or fraudulent alliances to manipulate or trying to manipulate the Games results.

11.5 Storage of the Personal Data

LN has implemented and maintain reasonable and appropriate technical, physical and organizational controls and measures in order to:
  • Ensure the security, integrity and confidentiality of the Personal Data,
  • Store the Personal Data in secure databases and systems with restricted access,
  • Protect the Personal Data against loss, accidental or intentional misuse, alteration,ndestruction and access by unauthorized persons.
In addition, payment information is managed by a PCI DSS-certified online payment service provider (international security standard ensuring the confidentiality, security and integrity of credit card and transaction data).

11.6 Transfer of Personal Data

The Personal Data is collected and processed by LN, acting as data controller. However, for specific services, purposes or processes, LN may share the Personal Data with subcontractors acting as data processors (in the sense of GDPR). The Personal Data are provided to these subcontractors/ data processors on a need-to-know basis and to the extent that is reasonably necessary for the proper management and maintenance of the Platform, management and maintenance of the Account, the proper performance of LN services and of the Games and/ or compliance with applicable regulation. Subject to the Player’s prior authorization, Personal Data may be shared with partner companies. LN has appointed its subcontractors within the framework of a specific contract.

LN carefully and diligently selects subcontractors established in European Union member states and/or in countries recognized by the European Commission as applying an equivalent level of personal data protection. LN requires its subcontractors to apply stringent personal data protection rules in compliance with the GDPR and all applicable laws and regulations.

LN also reserves the right to disclose the Personal Data to any court, judicial or administrative authority, when required or legally compelled to do so.

11.8  Player’s rights

The Player has the right to access, modify, correct and/ or request the deletion of the Personal Data at any time as well as to restrict or oppose to the use of his/ her Personal Data. However, if the Player oppose to the processing of his/ her Personal Data, such opposition will lead to an immediate closure of the Account. If the Player wishes to restrict or limit the processing of the Personal Data, it may be difficult or even impossible, depending on the case, for the Player to benefit from or access all or part of LN’s offers.
The Player is also informed that LN may not be able to accept the Player’s request to delete or tranfer (portability) the Personal Data since LN may have a legal obligation to keep and store certain Personal Data for a mandatory period.

11.9  Update of the Personal Data

If any of the Personal Data provided by the Player changes or becomes no longer up to date, the Player shall whether update such data through the Account or request to LN to modify the relevant information.

11.10  Additional information and claim

Additional information related to the Personal Data processing made by LN through the Platform is also available on the Privacy Policy published on the Platform.

If the Player considers that the processing of his/ her Personal Data infringes the requirements of GDPR, the Player is authorized to lodge a complaint with the CNPD (Commission Nationale pour la Protection des Données).

12. Liability

12.1  LN’s liability

LN shall only be liable and indemnify the Player for any loss, damage, liability, cost or expense incurred by him/her to the extent such loss, damage, liability, cost or expense directly results from LN’s gross negligence, willful misconduct, infringement to a third party’s IPR or fraud.
LN rejects any liability or responsibility for any loss, damage, liability, cost or expense that incurred by the Player, or a third party arising out of or related to:
  • The Player’s use, misuse or improper use of the Platform and any of its content,
  • The fraudulent or abusive use of the Platform or Prohibited practices by the Player,
  • The Player’s use of the Platform while being aware of the occurrence of a Failure,
  • Any breach of the GTC or the Betting rules by the Player,
  • The Player’s failure to provide complete, accurate and up-to-date information,
  • Any loss of connection due to unsuitable hardware, software and/ or connection parameters used by the Player and/ or any internet or communication failure,
  • The suspension or closure of the Account by LN, in accordance with the provisions of the GTC,
  • The unavailability of the Platform for maintenance;
  • Any event beyond LN’s reasonable control or force majeure event (as defined by Luxembourg Civil Law and Case Law).

12.2  Player’s liability

The Player shall be liable and indemnity LN and/ or any third party including other players for any claim, loss, damage, obligation, cost or expense incurred by them arising from:
  • The Player’s use, misuse, improper use of the Platform and any of its content;
  • Any willful default, negligence, fraud, misconduct or lack of good faith of the Player,
  • Any breach of the GTC or the Betting rules by the Player,
  • Any fraudulent use, abuse or Prohibited practices (or attempt to do so) by the Player.

13. Duration, suspension and termination

13.1 Duration

The acceptance of the GTC constitutes a valid and binding agreement between the Player and LN, effective as of the Player’s acceptance of the GTC. This agreement shall remain valid until the earlier of (i) the closure of the Account by LN in accordance with the terms of the GTC or (ii) the closure of the Account by the Player. For the avoidance of doubt, the closure of the Account automatically terminates the agreement in place between the Player and LN.

13.1  Suspension and inactive Accounts

13.1.1Cases of suspension

The Account may be suspended at any time by LN in accordance with sections 2, 3.1.1, 3.1.4, 2.2.3, 4.1, 4.2.5, 3.3, 4.2.4 and 9.2. In addition, LN reserves the right to suspend the Account when LN discovers or suspects an inappropriate or unauthorized use of the Account or when the Player’s action, behavior or betting practices are deemed by LN as inappropriate, inadequate or unauthorized.
The Player may also request the suspension of the Account in case of self-exclusion, as described in section 8.4.

13.1.2Consequences of the suspension of the Account

During the suspension of the Account, the Account will be frozen. During this freeze period, the Player will be unable to:
  • Access and credit the Account,
  • Make any use or transfer of the Available credits that will be retained by LN during the whole suspension period (except in case of self-exclusion or inactive Account), and
  • Take part to any bets through the Platform.
Amounts held or retained by LN do not earn any interest. In addition, LN reserves the right to charge to the Player fees for the holding of the Available credits.
It is agreed that the Player is not discharged or released from complying with the GTC during the suspension period.
 
13.1.3Duration

Suspension of the Account may be temporary or lead to the closure of the Account.
Suspension of the Account can only be lifted by LN, except in the case of self-exclusion by the Player. For instance, LN may decide to unfreeze an Account upon receipt of requested information or document from the Player or after completion of satisfactory investigation.
13.1.4Inactive Accounts

In case the Player has not logged in to his/her Account for a period 12 (twelve) consecutive months, LN shall send a notification by email to the Player. If no action is taken by the Player within the following 30 (thirty) days, LN shall suspend the Account and consider it as being inactive. LN will keep the Available credits until further information or instruction is received from the Player or until the applicable statutes of limitation have expired (in this case LN may decide to transfer the Available credits to the Caisse de Consignation). Available credits do not earn any interest. In addition, LN reserves the right to charge to the Player fees for the holding of the Available credits.
Despite the suspension of his/ her Account, the Player may reactivate his/her Account at any time whether by logging in on the Platform or by contacting LN. The Player may also, at his/ her choice, request a payout of the Available credits and/ or the closure of the Account.

13.2 Closure of the Account

13.2.1 Closure of the Account by the Player

The Player can request the closure of the Account, at any time,  by sending a termination email to support@loterie.lu. From the receipt of such request by LN, the Player will no longer be authorized to place any bet. Upon closure of the Player’s account, any bets that have been placed but remain unsettled at the time of closure shall be automatically cancelled. The amounts staked on such cancelled bets shall be reimbursed to the Player in full..
Closure of the Account will be effective 1 (one) business day after receipt of the Player’s request by LN.
If the Player wants to regain access the Platform after the closure of the Account, he/ she shall request LN to reactivate the closed Account subject to any identity verification process or other procedures hat LN may require. Notwithstanding the foregoing, LN reserves the right to refuse, at its sole discretion, the reactivation of a closed Account or the creation of a new account and for a period up to 5 (five) years.

13.2.2 Closure of the Account by LN

LN may close the Account for any of the reasons described in sections 2, 3.1.4, 3.1.4, 3.5, 4.2.4, 3.4.1, 8.4, 9.2 and 11.7. In some cases, LN will close the Account with immediate effect and without any further act or formality.
In addition to the above, LN may close the Account in the following cases:
  • The Player materially breaches any of the terms of the GTC and does not take any corrective action or remedy within 10 (ten) days following the receipt of a notice (sent by mail or through the Account) to do so sent by LN,
  • The Player becomes insolvent or bankrupt;
  • The Account is, suspended for more than 180 (one hundred and eighty) days and the Player has failed to take any corrective action or to remedy the situation.
In case of closure of the Account by LN for any reason, LN will notify the Player immediately by email that the Account has been or will be closed. After closure of the Account, LN reserves the right to refuse, at its sole discretion, the creation of a new account by the Player for a period up to 5 (five) years.
 
13.2.3 Consequences of the closure of the Account  

Subject to the provision of section 6.3,  when the closed Account is confirmed (as explained in section 3.1.2), the Available credits will be converted and transferred to the Player’s bank account in accordance with the provisions of section 6. Such transfer shall happen within 10 (ten) business days following the effective closure of the Account. LN reserves the right, for any reasonable grounds, to delay any payout or to request the provision of addional document or information before making any payment,.
When the closed Account is not confirmed (as explained in section 3.1.2), LN will retain the Available credits until it has received all necessary information from the Player and has performed satisfactory verification. In case no information is received from the Player, Available credits will be kept by LN for a period of 30 (thirty) years. During this period, the Player will be authorized to request the refund or return of the Available credits provided that he/she transmits to LN the requested information and documents and that the checks performed by LN are satisfactory. Amounts put in reserve do not earn any interest. In addition, LN reserves the right to charge to the Player fees for the holding of the Available credits.
After the expiry of the 30 (thirty) years period, the cash amount equivalent to the Available credits will be deposit with the Caisse de Consignation.

13.2.4 Retention of the Available credits by LN
Notwithstanding anything to the contrary in the GTC, LN is fully authorized to retain the Available Credits and refuse to transfer the withdrawable Available credits to the Player’s bank account in the cases described in section 6.3.

14. Query, dispute and claim resolution  

14.1 Contact

In case of query or if the Player needs some support, he/she can contact LN from Monday to Friday, from 8:30 to 17:00:

14.2  Claim

The Player has the right to bring a claim by sending an email to support@loterie.lu when he/ she is not satisfied with the level and/ or quality of the services provided by LN or when a Failure occurs.

The claim must be brought at most 6 (six) months after the occurrence of the Failure or cause of the Player’s dissatisfaction. LN has no obligation to deal with any claim related to a Failure or incident that happened more than 6 (six) months before the date of receipt of the claim.

Subject to the time limitation set out above, LN shall make reasonable efforts to reply to the Player as soon as reasonably practicable and to propose an appropriate solution or workaround. LN shall make reasonable efforts to implement the corrective measures or remedy within a maximum of 8 (eight) weeks. It is agreed that the delay for finding and implementing appropriate solutions shall also be  dependent on the Player’s responsiveness and involvement.

14.1  Dispute Resolution

If any dispute arises out of, or in connection with the GTC, the Platform or any service related to the Platform, LN and the Player shall, acting in good faith, make their best efforts to settle the dispute according to the process described in section 14.1 above.

In case the parties are not able to reach a settlement within 60 (sixty) days, either LN or the Player may (i) bring the claim or dispute to the competent court or (ii) request for arbitration. For the purpose of arbitration, LN has appointed the European Online Dispute Resolution (EU ODR) for Alternative Dispute Resolution (ADR).

The Player acknowledges that:
  • The EU ODR is not competent for matters that are (or that during the arbitration process will become) subject to a court action, or on matters, which in EU ODR’s opinion, would be more adequately handled by a regulator;     
  • EU ODR shall only be competent on a dispute or claim subject to the below cumulative conditions:
o   The Player has previously raised such claim or dispute to LN and has documented in writing the substance of dispute or claim; and
o   The Player agrees to the transfer of some of his/ her Personal Data to the EU ODR to the extent necessary for the handling and settlement of the claim/ dispute.

The Player is able to access freely to the ADR function. The European Online Dispute Resolution may be contacted by filling a dispute on the EU ODR website https://ec.europa.eu/consumers/odr/main/?event=main.complaints.screeningphase.

15.  Miscellaneous

15.1  Changes to the GTC

LN is authorized to change, supplement or replace the GTC at any time, at its discretion, and without requesting the consent of the Player. LN shall (i) inform the Player of any amended or new version through the Platform at the latest when such amendment or change becomes effective and (ii) request the Player’s acceptance of the amended or revised GTC. If the Player disagrees with the content of the changed, supplemented or replaced GTC, he/ she shall immediately stop using the Platform and request the closure of the Account.

16.1  Languages

The GTC will be drafted in English, German, Portuguese and French. In case of discrepancies between these versions, the French version shall always prevail and be considered as the authentic version of the GTC.

17.1  Assignment and set-off

The Player shall not assign or transfer any rights or duties he/ she may have under the GTC. He/ she cannot transfer or assign the Account to another person or player.
The Player is not allowed to assign against payment or free of charge, pledge or otherwise dispose of any claim, which he/ she may have against LN, from betting contracts.
The Player is also not entitled to set off any claims he/ she may have against LN with any claim that LN may have against him/her.

18.1  Severability

If any time, any provision of the GTC is declared invalid or unenforceable, to the fullest extent permitted by applicable laws:
  • The other provisions of the GTC shall remain in full force and effect; and
  • LN shall propose in good faith replacement or substitutive provisions which are legally binding, valid and enforceable. The meaning of such replacement clauses shall, to the extent reasonably possible, remain close to the original intention of the initial clause.

19.1  Remedies and waivers

No failure by LN to exercise, nor any delay by LN in exercising, any right or remedy hereunder shall operate as a waiver of any right or remedy hereunder. Any single or partial exercise of any right or remedy, shall not prevent any further exercise of that right or remedy.
The rights and remedies hereunder are cumulative and not exclusive of any rights or remedy set forth by the applicable laws.

20.1  Applicable law and competent jurisdiction

The GTC and the agreement between LN and the Player shall be constructed and construed in accordance with the laws of Luxembourg. The Player and LN agree that the courts of Luxembourg shall have exclusive jurisdiction for any action or proceeding related to the GTC and the agreement between LN and the Player.

Annex 1 – Betting Rules

Note. The present Annex 1 only governs the placement of bets on the Platform. All bets placed via Terminals shall be governed by the applicable Terminals Conditions.
 
A. Eligible events

1. Bets can only be placed on the outcome of future events. If a bet is accepted after an outcome is already known, bets on these markets are void (e.g. a first goal scorer bet after the first goal has been scored). If the bet is placed after the beginning of the betting event, the bet is void (this does not apply in play betting).
2. Data such as current scores and duration are sourced from a ‘live feed’ provided by a third party and may be subject to delay or potential inaccuracies. The Player who uses this information to determine his/her bets, does so entirely at his/her own risk. LN accepts no responsibility or liability of any kind for any loss or damage suffered by the Player as a result of the use or misuse of such live score data.

B. Pricing

1. All prices are subject to change and may be subject to restrictions on certain stake levels. Prices on selections change regularly to reflect fluctuations in the market or changes in the event, such as a goal being scored. Changes to the odds do not have any impact on bets that have already been placed and confirmed.
2. Prices offered on live betting are not guaranteed to remain available throughout an event, and players placing in-play bets acknowledge that further in-play bets on the event may not be available.

Ineligible players

1. Bets on events which the Player is a participant to or is involved in as, amongst others, a sportsperson, or as an owner, trainer, manager or coach are not permitted. In addition, bets on league, cup or other events in which the respective club is participating may not be placed by those considered to be participating in the respective event.
2. In the case of violation of these rules, LN reserves the right to refuse payment of any winnings as well as to cancel any bets.
3. LN takes no responsibility for knowing if the Player is a participant as described above. Accordingly, LN is entitled to reclaim monies at any time using the necessary measures after an ineligible Player becomes known LN and to report such business to the relevant sports authorities.
 
C. Assessment of the betting outcome and winnings

1. The assessment of the betting outcome applies uniformly to both regular bets (pre-match) and live bets.
2. The maximum amount that can be won with any ticket is 50 000€ (fifty thousand euros) for singles and combination bet and 100 000€ (one hundred thousand euros) for system bets, unless otherwise agreed by LN (i.e. in case of promotions or bonus).
3. For all bets, unless otherwise stated, the result after regular playing time applies.
4. The following regulations apply in particular to the assessment of the outcome of the bet:

a. The results announced immediately after the end of the betting event are decisive (e.g. award ceremony if this takes place immediately after the betting event): award ceremony, provided this takes place immediately after the betting event).
b. For football matches, the result after 90 minutes (regular playing time), for ice hockey matches after 60 minutes (regular playing time) is decisive. Any extra time or penalty shoot-outs etc. therefore have no influence on the betting contract, unless the parties to the contract have made a note to the contrary in the bookmaker's records (e.g. Who will advance? Who will win the cup, bets on extra time or penalty shoot-outs, etc.).
 
c. If a match is cancelled, all evaluations of betting outcomes that have already arrived remain valid. All submitted betting outcomes that have not yet arrived remain valid if:
  • This betting event is continued or added to within the following 48 hours, calculated from the originally scheduled start, or
  • The betting event is continued as part of a sporting tournament (e.g. tennis tournament, etc.).
5. In the case of "dead heat" (2 or more tied winners), the payouts are divided accordingly - the respective odds by the number of winners involved (e.g.: Stake EUR 100, odds on the winner: 1.8, results in a bet payout of EUR 180, with two winners the payout is therefore EUR 90 each, with three winners EUR 60 each). If only two starters (teams) take part in betting events (e.g.: training duel) and no draw odds are offered, the payouts will not be split in the event of "dead heat". In this case, the bet is void and the entire stake is refunded.

D. Invalidity or cancellation of bets

1. Unless specified otherwise in the specific sport rules, all bets for abandoned or postponed matches will be void, unless the match is re-scheduled and played within the next 24 hours. In this case, bets will stand. All markets that have been determined at the time of interruption or abandonment will be settled according to the result at the time of the interruption or abandonment.

2. In the following cases, the bet is invalid or the betting contract is subsequently cancelled by mutual agreement, with the legal consequence that the stake must be refunded to the betting customer:
a. If the betting event does not take place as stated (e.g.: reversed home right, unless the home team - for whatever reason - exercises its home right at a foreign sports facility).
 
b.If the bet is placed after the actual start of the betting event on which the bet is based or not in accordance with the betting regulations. However, this does not apply to those bets which, due to their nature, are continuously offered by the bookmaker even after the start of the betting event and are labelled as such bets - which can be placed even after the start of the betting event, for example long-term bets or live bets. The time determined by the bookmaker for the conclusion of the betting contract is binding for the betting customer.
 
c. If a betting event is cancelled or does not take place, unless
ca) this betting event is subsequently recorded within the following 48 hours, calculated from the originally scheduled start, or
cb) the betting event is subsequently recorded as part of a sporting tournament event (e.g. World and European Championships, tennis tournament, etc.).

d. If the betting event is cancelled without an official classification taking place immediately after the cancellation. Subsequent changes to the ranking (e.g. decisions "at the green table") are therefore not taken into account.
 
e.If a tennis match is terminated by w.o., a tennis player has not started the match or a tennis player is disqualified.

3. For bets on championships, overall winners of tournaments (e.g. World Cup, European Championships, golf and tennis tournaments), "play or pay" applies: If the betting event takes place in accordance with these General Terms and Conditions and Betting Regulations and a participant or team does not take part in this event, gives up during the tournament or is disqualified, the betting contract remains valid; this means that a bet on an affected participant or team is deemed to have lost for the betting customer.
4. If, as a result of a human or system error, a bet is accepted at a price (including odds, handicap terms or other terms or details of the  bet) that is materially different from those available in the general market at the time the bet was made, LN reserves the right to void all affected selections.
5. If several betting events are combined in one bet ("combination bet"), the following applies:

a. If one or more events are cancelled, aborted or do not take place for other reasons without a supplement in the sense of point B3 c or without an official evaluation in the sense of point B3 d, these betting event(s) shall be evaluated with odds of 1.0. This also applies to tennis matches that are cancelled if a tennis player does not show up for the match or if a tennis player is disqualified.

b.If all betting events are cancelled, aborted or do not take place for other reasons without a supplement in the sense of point B3 c or without an official evaluation in the sense of point B3 d, then the betting contract is cancelled retroactively and the stake must be refunded. This also applies to tennis matches terminated by w.o., if a tennis player does not turn up for the match or if a tennis player is disqualified.
 
E. Related Contingencies

Accumulators or multiple bets are not accepted where the outcome of one part of the bet contributes to the outcome of another. Any such bets that are accepted in error will have the stake split equally between the selections for settling purposes.

F. Settlement

1. The official association websites are used to evaluate all betting markets offered.
International football matches according to www.fifa.com or www.uefa.com.
2. For settlement purposes, the initial official result, published by the official governing body immediately after the match or event is finished, will be considered final. Unless a specific sport’s rules (see below) state otherwise this will apply to all events. Any subsequent changes to results whether due to disciplinary hearings or otherwise will be disregarded
3. If the official result of a sporting bet is not available, the result will be determined at LN’s sole discretion with reference to all accessible evidence.
4. LN reserves the right to apply a dead heat reduction on any event where more winners are declared than were originally specified.
5.In the case of the withdrawal of a named team or participant from a competition LN reserves the right to apply a deduction equivalent to Tattersalls Rule 4(C) to any outright or group betting where the competitor was listed.

G.Bets manipulation or abuse

1. Players must register their bet requests as individuals. Repeated requests containing the same selections may be subsequently deemed void. Bet selections may be deemed void if LN believes that players are acting in collusion or as a syndicate or the bets in question have been placed by one or more players within a short period of time.
2. In the event LN suspects any event manipulation, it reserves the right, at its entire discretion, to:
  • Suspend any offering of any event or series of events in any of its markets; and
  • Delay and/or withhold payment on any event or series of events in any of its markets until the integrity of such event or series of events has been confirmed by the relevant sports federation.
Further, in the case of active event manipulation being confirmed as having taken place by the appropriate governing body, LN reserves the right, at its discretion, to suspend any bets placed on such events, either by any Player identified as having possessed insider betting knowledge or information by any other Player who, in LN’s reasonable opinion, is connected to acting in conjunction with or is in any way involved with such Player.

H. Each Way (EW)

1. All bets are settled to win unless each way is stated
2. An each way bet is a bet of twice the elected stake. One bet is on the selection to win the event and one bet is for the selection to be placed according to the EW terms stated for the event.
3. Each way multiple bets are settled win-to-win and place-to-place.
 
I. Early Cash Out

1. With the Early Cash out feature it is possible for the Player to take advantage of the current standing of the bet before the natural conclusion of an event. The price of the early cash out value offered depends on the performance of the chosen selection on the ticket. It can be lower or higher than the original stake.
2. Early cash out is available only for designated sports, events, fixtures or markets and can be offered prematch and in play. A time delay will be in place when an early cash out is requested. When prices are changing or markets are suspended during the time delay, the cash out might not be successful, and a corresponding message will be displayed.
3. LN does not guarantee the availability of the cash out option at any time, even if it has been previously available. In case LN suffers from a service interruption or experience any technical difficulties the cash out option can be affected. In these circumstances LN will not be held responsible for any downtime or malfunction.

A.Head-to-Head Betting
9. The winner of a head-to-head duel is the better-placed participant in the final ranking, unless stated otherwise. The official final result applies. Both participants must start for the bet to be valid. If, for whatever reason, a participant does not start the competition, all bets placed on this head-to-head will be valued at 1.0.

Supplement Alpine Skiing:
The following applies to slalom, RTL and combined: If a participant does not qualify for the 2nd run, this participant is deemed to have been eliminated. If both participants do not qualify for the 2nd round, both participants are eliminated.

Additional ski jumping:                                                                                        
If both participants do not qualify for the 2nd round, the better placing in the 1st round applies.

General live betting
10. Unless otherwise stated (e.g.: Who will be promoted? Who will win the cup? etc.), the result after regular time applies to all bets.
11. The validity of the live bet is completely independent of whether there is a live broadcast of the event, as the bookmaker has no influence on the broadcast of events. All bets will be settled after the end of the event once an official result is available.
12. All additional information - such as: Match time, score etc. - are without guarantee.
13. Bets that are placed after the actual outcome of the bet has been determined are valued at odds of 1.0.
14. The bookmaker reserves the right to assess bets placed in the period of match-deciding situations (penalties, red cards, changes of decision by referees and/or video referees, etc.) at odds of 1.0.
